Terms of Service

These terms are a contract between you and Grafting LLC (“Catholify,” “we,” “us”) for the Catholify apps on iOS, Android, and the web, including public prayer pages. By creating an account, posting content, buying a subscription, or otherwise using Catholify, you agree to these terms and to our Privacy Policy. If you do not agree, do not use Catholify.

Grafting LLC is an Alabama limited liability company. It operates Catholify. Email admin@grafting.us for legal questions. Email support@catholify.com for help with a Catholify account or subscription.

The service

Catholify is a social prayer product. You can keep prayer intentions, publish prayer requests and related content, and pray with other people. The core service is free and does not require a subscription. A paid subscription unlocks additional features.

Someone may share a public prayer page by URL. Anyone with that link can view the page, including people who do not have an account. Viewing a public page does not let you post. Posting, commenting, and other participation require an account.

When you mark a prayer public, we may share it outside the app so that more people can pray. We may publish it on channels we operate, such as a podcast, an email, a social post, the Catholify community, or another invitation to pray. A daily podcast is one example. We do not use public prayers to advertise or sell a subscription.

Eligibility

You must be at least 13 years old to use Catholify. If you are under 13, do not use the service. We may close an account we learn belongs to someone under 13 and delete the information associated with it.

Some countries set an age above 13 for agreeing to an online service on your own. If that applies to you, you may use Catholify only with a parent or guardian’s permission, and that adult agrees to these terms on your behalf.

You may use Catholify only if the law allows you to form a binding contract, or a parent or guardian has agreed for you as described above.

Accounts

You can create an account with an email sign-in link or code, Sign in with Apple, or Sign in with Google. You agree to give a name and email address that we can use to reach you. You are responsible for activity on your account and for keeping access to your email and Apple or Google account secure. Tell us at support@catholify.com if you believe someone else is using your account.

You can delete your account in the app. Deletion is described in the Privacy Policy.

Subscriptions

Optional subscriptions are billed by Apple or Google for in-app purchases, and by Stripe for purchases on the web. Before you confirm a purchase, we show the price, the billing period, and what the subscription unlocks. A subscription renews for the same period at the then-current price until you cancel.

You can cancel at any time. Cancel an Apple subscription in your Apple ID subscription settings, a Google Play subscription in Google Play, and a web subscription from your account or by emailing support@catholify.com. Cancellation stops the next charge. Access to paid features continues through the end of the period you already paid for.

If you bought a subscription by mistake, email support@catholify.com and we will refund it. If Apple or Google processed the payment, you can also request the refund through that store, and we will help you get a mistaken purchase refunded.

Your content

You keep ownership of the content you submit. For content you limit to friends, a group, or yourself, you grant Grafting LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as needed to operate, secure, moderate, and improve Catholify, and to show it to the people allowed by the visibility setting you chose.

For a prayer or other content you mark public, that license also includes using, reproducing, displaying, distributing, and excerpting the content, together with your name and profile photo, to invite others to pray. We may publish it on channels we operate, such as a podcast, email, social media, the Catholify community, or other invitations to pray. We will not use it to advertise or sell a subscription or other product.

If you later narrow a public prayer’s audience or delete it, we will stop using it in new publications. Material already published, such as a podcast episode, email, or post, may continue to include it. For other content, the license ends when the content is removed from the service, except for a reasonable period needed to delete it from backups and systems, consistent with the retention described in the Privacy Policy, and except for content other users have already lawfully received.

You promise that what you publish is your original work, or that you have permission to post it, and that posting it does not violate anyone else’s rights. You are responsible for your content.

Acceptable use

Catholify is for charitable, uplifting prayer and inspirational content. Anything else does not belong on the service. You agree not to post or do any of the following:

Moderation

We moderate Catholify both by reviewing content ourselves and by acting on reports. We may remove content, refuse to publish it, limit its visibility, and suspend or terminate accounts, with or without notice, when we believe these terms were violated or that the action protects the community. We are not obligated to host any particular piece of content.

Moderation is not real-time emergency monitoring. See the next section.

Not medical, mental-health, or pastoral care

Catholify is a prayer app. It is not medical care, mental-health care, counseling, or pastoral care. It does not create a clergy, therapist, or doctor relationship. Nothing on Catholify is a substitute for professional advice or for emergency services.

If you or someone else may be in danger, contact local emergency services. In the United States you can call or text 988 for the Suicide and Crisis Lifeline.

Posts that describe self-harm, abuse, a medical emergency, or similar crises are still subject to removal under these terms. Removing a post, or failing to see one, is not a promise that we will intervene, contact authorities, or provide help.

Copyright complaints

We respond to notices of alleged copyright infringement that meet the Digital Millennium Copyright Act, and we may terminate the accounts of repeat infringers.

A copyright notice to the agent must include:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work you claim was infringed
  3. Identification of the material you claim is infringing, and information reasonably sufficient for us to find it, such as a URL
  4. Your name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act for the owner

If you believe we removed or disabled your content by mistake, you may send a counter-notice to the same agent. A counter-notice must include your physical or electronic signature, identification of the material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or the Northern District of Alabama if you are outside the United States, and that you will accept service of process from the person who sent the original notice.

Apple and Google

If you downloaded Catholify from the Apple App Store, these terms are between you and Grafting LLC, not Apple. Apple is not responsible for Catholify or for any maintenance or support. If Catholify fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app if you paid one. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for claims relating to the app, including product-liability claims, consumer-protection claims, or claims that the app infringes intellectual property. You must comply with any applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to Apple’s Media Services terms.

If you downloaded Catholify from Google Play, you must comply with Google Play’s terms of service. Google is not responsible for Catholify or for the content you submit.

Disclaimers

Catholify is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any prayer will be seen or answered.

Limitation of liability

To the fullest extent permitted by law, Grafting LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or content, arising out of or related to these terms or Catholify. Our total liability for any claim arising out of or related to these terms or the service will not exceed the greater of the amount you paid us for Catholify in the twelve months before the claim, or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. This section does not limit liability that cannot legally be limited, including for death or personal injury caused by negligence where the law forbids that limit.

Indemnity

You will indemnify and hold Grafting LLC and its members, employees, and agents harmless from claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your content, your use of Catholify, or your violation of these terms or of someone else’s rights.

Disputes, arbitration, and class-action waiver

Please read this section. It limits how disputes can be brought. You and Grafting LLC agree to resolve disputes by individual arbitration, and you waive the right to a jury trial and the right to participate in a class action.

Before starting arbitration, you agree to email admin@grafting.us with a short description of the dispute and the relief you want, and to try in good faith to resolve it informally for 30 days.

If the dispute is not resolved, either of us may start binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement. The seat of arbitration is Birmingham, Alabama. Hearings may be held by telephone or video. The arbitrator may award the same individual relief a court could award. Judgment on the award may be entered in any court with jurisdiction.

Arbitration will be conducted only on an individual basis. Class, collective, and representative actions are not allowed, and the arbitrator may not combine more than one person’s claims. You and Grafting LLC waive any right to a jury trial.

Either of us may bring an individual claim in small-claims court instead of arbitration. Either of us may ask a court for provisional injunctive relief to protect intellectual property or to stop unauthorized access to the service. If a court finds that the class-action waiver is unenforceable as to a particular claim, that claim proceeds in court and not in a class arbitration, and the rest of the arbitration agreement still applies.

You may opt out of this arbitration agreement by emailing admin@grafting.us within 30 days after you first accept these terms. Put “Arbitration opt-out” in the subject line and include your name and the email address on your account. Opting out does not affect any other part of these terms.

The laws of the State of Alabama govern these terms, except that the Federal Arbitration Act governs the arbitration agreement. Conflict-of-law rules do not apply. Subject to the arbitration agreement, the state and federal courts located in Jefferson County, Alabama have exclusive jurisdiction.

Ending the service

You may stop using Catholify and delete your account at any time. We may suspend or terminate access, or stop offering the service, if you violate these terms, if we need to protect other users, or if we discontinue Catholify. Sections that by their nature should survive, including content licenses still needed to wind down the service, disclaimers, limits of liability, indemnity, and the dispute terms, will survive.

Changes

We may update these terms. We will post the new version on this page and change the date above. If we make a material change, we will also give notice in the app or by email. If you continue to use Catholify after the update takes effect, you agree to the updated terms. If you do not agree, stop using Catholify and delete your account.

Other terms

If a court holds part of these terms unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These terms are the entire agreement between you and Grafting LLC about Catholify and replace earlier agreements about the service. You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
